There was fault by the Council. Following the annual review meeting, it did not meet statutory timescales when issuing its notice to amend the Plan and issuing the amended final EHC Plan. Because of the fault, Mrs B suffered distress and frustration and her right to appeal to the Tribunal was delayed. The Council has agreed to apologise to Mrs B and make a symbolic payment.
