    Summary: Miss X complained about the Council’s handling of her child’s Education, Health and Care (EHC) Plan and education over a number of years. We find the Council at fault for delays in completing the annual review and reassessment process, failing to review the personal budget as required, missing direct payments, and failing to address the free school meal issue when Miss X raised it. These faults caused uncertainty about whether her child should have received additional provision, financial pressure for the family, and time and trouble for Miss X pursuing the matter. The Council has agreed to apologise, make a payment to Miss X, and complete the EHC Plan process.

The Council remedied the injustice by backdating the families priority before the complaint was considered by the Ombudsman and has confirmed the family did not lose out on any housing offers due to the delay. The Council has allocated properties according to its housing policy and plan.

We cannot investigate Mrs X’s complaint about her son’s lack of education, because this was a direct consequence of the Council’s decision to name his school in his plan. Mrs X was given a right of appeal to the Tribunal about this matter, and it was reasonable to expect her to use that right.

However, we find fault in its failure to properly assess suitability at the outset, delays in addressing serious hazards, and delay in completing a suitability review. This caused the family prolonged distress and uncertainty, and meant they lived in unsuitable accommodation for an extended period and continue to do so. We recommend the Council apologise, make a financial payment to Mrs X, and take further action to address hazards.
