Summary: the Council delayed completing an annual review for an education, health and care plan and in producing the final plan, failed to ensure some elements of provision in the plan were put in place, failed to consider a request for a speech and language therapy assessment and failed, on occasion, to respond to Mrs B’s contact until she chased the Council. An apology, payment to Mrs B, reimbursement of the amount she paid for her own speech and language therapy assessment and arrangement for the outstanding provisions to be put into place is satisfactory remedy.

Summary: Miss X complains the Council has unreasonably refused her application for her summer-born child to defer entry to the Reception year group at the school of her choice. As a result, she says her child has been denied the place to which she is entitled. We find fault with the Council for delay and for failing to properly communicate the reasons for refusing the deferral at one school. We have agreed remedies to ensure this does not happen again.

Summary: The complainant alleged that there was delay in providing her daughter, who has special educational needs, with alternative education during her school years when studying for her General Certificates of Secondary Education (GCSEs). The complainant also alleged the Council delayed in issuing an Education, Health and Care (EHC) Plan. The Council has accepted fault on most aspects of the complaint. We have recommended a way to remedy the resulting injustice which the Council has accepted. We have therefore completed our investigation and are closing the complaint.
