She also complains the Council did not pursue a referral for Speech and Language Therapy and told untruths about her to delay a tribunal appeal. We find fault in the complaint, but we consider the fault did not cause a significant injustice or has already been remedied by the Council.

    Summary: Mrs X complained the Council delayed in producing an Education Health and Care Plan for her child. Ms X says her child has been out of education since December 2021. We found fault with the Council’s delays and lack of education provision for Mrs X’s child. The Council agreed to apologise to Mrs X and pay her £400 for delays outside the Education Health and Care Plan assessment process and £6,000 for missed education.

    Summary: We will not investigate this complaint about the Council’s actions concerning Mrs X’s child’s special educational needs and educational provision since 2020. The complaint about the child not receiving sufficient education from early 2020 is late and there is no good reason to exercise discretion to investigate this now. Other matters are not separable from a right to appeal to a Tribunal that Mrs X used. A legal ruling prevents us investigating matters between July 2021, when the Council issued an Education Health and Care Plan, and July 2022, when it issued a fresh Plan. There is not enough evidence of injustice caused by fault by the Council in the remaining matters to warrant investigation by us.

    Summary: Mrs X complained the Council did not complete relevant transport assessments as part of her daughter’s move to post-16 education and that her appeals about transport costs were not heard fairly. We have found fault because the Council did not carry out necessary assessments or share information in a timely manner. To remedy the injustice caused by these faults, the Council has agreed to apologise, make a payment to Mrs X and update us on its progress in reviewing its procedures.

She complains the Council said the plan would specify special educational provision for B, but the final Plan said his needs could be met in a mainstream school with additional support. The Council has offered a suitable remedy for the impact of the delay. The Ombudsman cannot resolve Ms M’s complaint about the content of the Plan.

    Summary: Mrs X complains that her appeal for a place for her son at the School was wrongly heard by written submissions. The School is at fault as it did not give Mrs X at least 28 days in which to lodge her appeal. This denied her the opportunity of a face to face hearing. The appeal panel is also at fault as there is no evidence to show why it considered Mrs X’s reasons for wanting a place at the School outweighed prejudice to the School. The School has agreed to remedy the injustice to Mrs X by offering a fresh face to face appeal.
