  • Rochdale Metropolitan Borough Council (23 007 387)

Statement Closed after initial enquiries Other 24-Apr-2024

Summary: We will not investigate this complaint about the removal of graffiti. Any injustice is not significant enough to justify our involvement. In addition, further investigation would not lead to a different outcome.

  • Rochdale Metropolitan Borough Council (23 018 641)

Statement Closed after initial enquiries Council tax 17-Apr-2024

Summary: We will not investigate this council tax complaint. This is because part of the complaint has been considered in court and there is another part the complainant says he will take to court. For other issues there is insufficient evidence of fault by the Council and the complainant could complain to the Information Commissioner.

  • Rochdale Metropolitan Borough Council (23 005 108)

    Statement Upheld Alternative provision 16-Apr-2024

Summary: The Council took too long to make alternative educational provision for Miss B’s son when he was excluded from school and while he was waiting for a new school place to be confirmed with special educational provision. The Council also did not always communicate with Miss B properly. This caused Miss B distress and frustration and meant that her son went without the education he was entitled to. The Council has agreed to my recommendations to remedy the injustice it has caused.

  • Rochdale Metropolitan Borough Council (23 017 889)

Statement Closed after initial enquiries Commercial and contracts 11-Apr-2024

Summary: We will not investigate Mrs X’s complaint about the Council’s variation of an agreement for the lease of garden land. This is because we cannot determine the Council’s intentions at the time of the original agreement and if Mrs X believes it has breached the terms of the agreement it would be reasonable for her to take the matter to court.

  • Rochdale Metropolitan Borough Council (23 011 799)

    Statement Not upheld Safeguarding 08-Apr-2024

Summary: Mr H complained about how the Council investigated and responded to safeguarding allegations made against Mrs J. Mr H said this caused Mrs J to lose employment with a new employer and affected her mental health. We did not find fault with the Council’s actions.

  • Rochdale Metropolitan Borough Council (23 017 403)

Statement Closed after initial enquiries Traffic management 19-Mar-2024

Summary: We will not investigate this complaint about the Council’s decision to not remove speed bumps along a residential road. This is because the Council made its decision having properly considered relevant factors which are evidence and policy based. We are unlikely to find fault with how the Council made its decision and cannot therefore question the outcome.

  • Rochdale Metropolitan Borough Council (23 001 015)

Statement Closed after initial enquiries Other 28-Feb-2024

Summary: We will not investigate this complaint about how the Council has dealt with a report of fly-tipped waste. This is because there is insufficient evidence of fault.

  • Rochdale Metropolitan Borough Council (23 016 192)

Statement Closed after initial enquiries Other 26-Feb-2024

Summary: We will not investigate this complaint about the Council’s actions when Miss X looked after her grandchild. Investigation by us would be unlikely to add to the Council’s investigation, and part of the complaint is not separable from issues of contact with the child, which is a matter for a court that we are legally prevented from investigating.

  • Rochdale Metropolitan Borough Council (22 001 690)

    Statement Upheld Private housing 05-Feb-2024

Summary: Miss X complains about the Council’s handling of her concerns about disrepair in her privately rented property from December 2021 to May 2023, when she moved out. The Council was at fault for not taking formal enforcement action against the landlord when it identified category 1 hazards in the property, which caused injustice. The Council’s determination the landlord’s eviction attempt was not retaliatory was unclear but did not cause Miss X significant injustice. The Council has agreed to apologise and make a payment to Miss X. It will also share this decision statement with relevant staff to reinforce the recent training it has already completed.

  • Rochdale Metropolitan Borough Council (23 004 568)

    Statement Upheld Charging 21-Dec-2023

Summary: Mrs X complains the Council did not assess her daughter Ms Y’s care charge properly. We have not found fault in the Council’s decision making. However, there were significant delays by the Council in advising Mrs X and responding to her complaints. The Council has agreed our remedy.
