  • City of York Council (23 014 467)

Statement Closed after initial enquiries Enforcement 30-Jan-2024

Summary: We cannot investigate this complaint about the Council’s decision not to take enforcement action in relation to a planning condition attached to a development in Mr X’s locale. This is because Mr X is complaining as a councillor and not a member of the public so the complaint falls outside our jurisdiction.

  • City of York Council (23 007 320)

Statement Upheld Refuse and recycling 15-Jan-2024

Summary: Mr X complained the Council had failed to collect his household waste on multiple occasions since December 2022. We found fault because of the failed collections and ineffective monitoring to improve the situation. To remedy the injustice caused, the Council has agreed to apologise, make a payment to Mr X and share guidance with relevant officers.

  • City of York Council (23 006 625)

Statement Not upheld Parking and other penalties 05-Jan-2024

Summary: Ms X complained about the Council’s decision to refuse to issue her with a physical parking permit for one of its car parks. Ms X also complained about the Council’s parking policy. There was no fault in the Council’s decision-making.

  • City of York Council (23 011 812)

Statement Closed after initial enquiries Direct payments 04-Dec-2023

Summary: We will not investigate this complaint about proposed changes to adult social care direct payments, and delay in responding to a complaint. There is no fault in a council proposing to make a change, and at this point there is no injustice caused by the proposal. We would not investigate the complaint handling separately and it does not cause significant injustice to justify our involvement.

  • City of York Council (22 015 072)

    Statement Upheld Charging 15-Nov-2023

Summary: There was fault by the Council which failed to address Mr X’s complaint about the Deprivation of Liberty Safeguards for his mother Mrs Y. There was also delay in giving feedback on safeguarding enquiries. This caused avoidable distress, frustration and time and trouble. The Council will apologise, make Mr X a symbolic payment and review its procedures for requests for standard authorisations.

  • City of York Council (23 007 897)

Statement Closed after initial enquiries Commercial and contracts 10-Nov-2023

Summary: We will not investigate Mr X’s complaint about the Council’s failure to fulfil its promise to enter into a tenancy agreement with his business. This is because we cannot achieve any worthwhile outcome for Mr X. The courts are better placed to determine if the Council has breached the terms of any formal or informal contract and to decide any losses or remedy for the impact of its actions.

  • City of York Council (23 002 741)

    Statement Not upheld Enforcement 03-Sep-2023

Summary: Mr X complained about the Council’s actions when it served a planning enforcement notice on his son, a minor. We will not investigate this complaint further. This is because there is ongoing enforcement action. Mr X can raise his concerns about service of the enforcement notice with the court, should it go that far.

  • City of York Council (23 003 984)

Statement Closed after initial enquiries Special educational needs 21-Aug-2023

Summary: We will not investigate this complaint about the Education Health and Care Plan process when the complainant moved into the Council’s area. This is because the claimed injustice is not significant enough to warrant an investigation.

  • City of York Council (23 005 471)

Statement Closed after initial enquiries Highway repair and maintenance 19-Jul-2023

Summary: We will not investigate Mr B’s complaint that his property is being damaged due to the Council’s failure to maintain the road outside his home. This is because it is reasonable for Mr B to take the Council to court, which is in the best position to decide the matter.

  • City of York Council (22 018 188)

Statement Closed after initial enquiries Rights of way 10-Jul-2023

Summary: We will not investigate this complaint about the Council’s refusal to ensure a hedge overgrowing the highway is cut back. The Council has provided evidence the hedge is due to be cut back within four weeks of this decision statement. Further investigation will not lead to a different outcome.
