  • Bournemouth, Christchurch and Poole Council (22 017 348)

Statement Upheld Refuse and recycling 10-Jul-2023

Summary: Mr X complains the Council was at fault in the way it dealt with his request to replace refuse bins after being damaged by the Council’s collection teams causing distress. The Council has accepted it was at fault by initially advising Mr X it would replace his bin free of charge. It has already apologised which is suitable action for it to take. We have found no evidence of fault in the way the Council decided Mr X was required to pay for a replacement bin, so we have completed our investigation.

  • Bournemouth, Christchurch and Poole Council (23 004 020)

Statement Closed after initial enquiries Other 10-Jul-2023

Summary: We cannot investigate Mrs X’s complaint because it lies outside our jurisdiction. The law prevents us from investigating complaints about matters that are, or have been, considered in court.

  • Bournemouth, Christchurch and Poole Council (22 008 789)

Statement Upheld Special educational needs 03-Jul-2023

Summary: Mrs X complains the Council failed to properly advise her about the choices available for B’s education arrangements. She says the Council named Elective Home Education (EHE) on B’s Education, Health and Care (EHC) Plan, even though she had not asked for this. Mrs X also complains the Council failed to secure special educational provision for B and failed to issue an amended Final EHC Plan. We have found the Council at fault for not addressing Mrs X’s concerns about EHE and for not securing B’s special educational provision in full. We have made recommendations to remedy the injustice caused.

  • Bournemouth, Christchurch and Poole Council (23 003 164)

Statement Closed after initial enquiries Fostering 27-Jun-2023

Summary: We will not investigate this complaint about the way the Council ended a long-term foster placement with Mr X and his wife. Investigation by us would be unlikely to add to the Council’s own investigation or to achieve a different outcome.

  • Bournemouth, Christchurch and Poole Council (23 003 659)

Statement Closed after initial enquiries Trees 22-Jun-2023

Summary: We will not investigate this complaint about damage caused to the complainants’ property by Council owned trees. This is because it would be reasonable for the complainants to pursue the matter in court.

  • Bournemouth, Christchurch and Poole Council (22 004 234)

    Statement Upheld Allocations 21-Jun-2023

Summary: Mrs Y complains there were delays in the Council’s handling of her housing register application. The Council has already accepted there were delays. Mrs Y also complains the Council failed to consider all the information she provided in her application and give her clear reasons for its decisions about her application, including in its review decision. We have upheld Mrs Y’s complaint. This is because we have seen evidence of fault by the Council causing Mrs Y injustice. To remedy this, the Council has agreed to apologise to Mrs Y, make her a payment and make a clear decision now about her bedroom entitlement. The Council has also agreed to carry out several service improvements.

  • Bournemouth, Christchurch and Poole Council (23 002 420)

Statement Closed after initial enquiries Child protection 21-Jun-2023

Summary: We cannot investigate Mr X’s complaint about the Council’s attempts to place his children into care. This is because, the issues Mr X raises cannot be separated from matters that were decided in court, so we have no remit to investigate.

  • Bournemouth, Christchurch and Poole Council (22 014 203)

Statement Upheld Councillor conduct and standards 19-Jun-2023

Summary: We find the Council correctly addressed Mr X’s complaint about a breach of the Member Code of Conduct, but there was delay in referring his complaint to the Monitoring Officer and failure to provide updates. The Council should apologise to Mr X for the delay and avoidable frustration. It has introduced service improvements to prevent recurrence but should also provide us with evidence of the changes. It should also remind staff handling Code of Conduct complaints of the need to provide timely responses to complaints, complainant emails and updates in the event of delays.

  • Bournemouth, Christchurch and Poole Council (22 012 961)

Statement Not upheld Assessment and care plan 18-Jun-2023

Summary: The complainant, Miss Y, complained the Council failed to understand her care needs and provide the support she needs to meet them. We are satisfied the Council considered all relevant evidence and followed the proper procedures when carrying out Miss Y’s care needs assessment and the following review. Therefore, we do not find the Council at fault.

  • Bournemouth, Christchurch and Poole Council (23 002 682)
