Summary: Mrs X complains the Council failed to provide alternative provision after her son Y, become a school refuser. We have concluded our investigation having made a finding of fault. There were periods when the Council failed to ensure Y was receiving alternative provision, and I have not seen evidence the Council appropriately considered its section 19 duty. We also found fault after matters drifted when attempting to secure a placement for Y to begin in September 2022. Further, we found that Mrs X was not always kept informed, and there were instances when the Council failed to respond to Mrs X. The Council have agreed to our recommendations.

Summary: Miss X complained the Council delayed in assessing her child, B, for an Education, Health and Care (EHC) Plan. Miss X also complained the Council failed to confirm whether it would issue an EHC Plan to B within the statutory timescales and failed to communicate effectively. This caused avoidable frustration, distress, and uncertainty as to whether B had missed special educational provision. We have found the Council at fault. We have made recommendations to remedy the injustice caused.

Summary: Mrs X complains that the Council failed to take sufficient action to deal with nuisance from commercial bins and failed to respond to her complaint. There is no evidence of fault in how the Council investigated Mrs X’s complaints about nuisance from the bins. The Council delayed in dealing with Mrs X’s complaint about insufficient action by the Council which put her to avoidable time and trouble and caused distress to her. The Council has agreed to remedy this injustice by sending a written apology to Mrs X and making a symbolic payment of £200 to her.

Summary: Ms X complained the Council failed to take action when she was groomed and sexually exploited as a child in its care, allowed her to remain in inappropriate placements and breached her confidentiality causing her to suffer from PTSD and live in fear of being tracked down by a family member. This investigation did not reinvestigate the issues that were appropriately investigated through the Statutory Children’s Complaints Procedure. We are recommending a payment in respect of the delay in moving Ms X from the kinship placement in 2009.

This caused avoidable time and trouble and a loss of provision. The Council will apologise, make Ms X a symbolic payment and arrange and pay for the six hours weekly tuition Ms Y missed out on in the school year 2022-2023.
