  • Bristol City Council (22 013 084)

Statement Upheld Special educational needs 19-Jun-2023

Summary: Ms X’s son, Mr Z, missed out on several academic terms’ worth of physiotherapy and hydrotherapy that he was entitled to receive, as it was in Section F of his Education, Health and Care Plan (EHC Plan). This injustice was caused by Council fault - mainly service failure - due to the national shortage of physiotherapists and lack of capacity at hydrotherapy services. In recognition of the injustice caused, the Council has agreed to apologise, pay Mr Z £1,050, pay Ms X £300 and carry out service improvements.

  • Bristol City Council (23 002 407)

Statement Closed after initial enquiries Traffic management 14-Jun-2023

Summary: We will not investigate this complaint about the Council refusing to lower the volume of the audible warning signals at a pedestrian crossing close to the complainant’s home. We have not seen evidence of fault in the Council’s actions.

  • Bristol City Council (23 002 947)

Statement Closed after initial enquiries Parking and other penalties 12-Jun-2023

Summary: We will not investigate this complaint about a Penalty Charge Notice because there is not enough evidence of fault to justify investigating.

  • Bristol City Council (23 001 436)

Statement Closed after initial enquiries Homelessness 07-Jun-2023

Summary: We will not investigate this complaint about a comment a Council officer allegedly made to the complainant. This is because it is unlikely we could add to the Council’s response and we cannot achieve part of the outcome the complainant would like to achieve.

  • Bristol City Council (23 001 953)

Statement Closed after initial enquiries Highway repair and maintenance 30-May-2023

Summary: We will not investigate this complaint about highway maintenance responsibilities. This is because the court is better suited to consider the issues raised in the complaint.

  • Bristol City Council (23 001 394)

Statement Closed after initial enquiries Covid-19 25-May-2023

Summary: We will not investigate Mr X’s complaint that the Council should not pursue him for unpaid business rates over periods of national lockdowns resulting from the COVID-19 pandemic. This is because there is not enough evidence of fault by the Council.

  • Bristol City Council (22 014 958)

Statement Not upheld Planning applications 22-May-2023

Summary: We ended our investigation into Mr X’s complaint about the Council’s decision to approve his neighbour’s planning application. This is because it is unlikely we would find fault and a further investigation would not lead to a different outcome.

  • Bristol City Council (22 010 485)

    Statement Upheld Allocations 15-May-2023

Summary: Mrs X complained the Council failed to properly consider additional evidence she submitted for a review of her housing priority. There was no fault in the Council’s review decision, but there was a delay in the review process. The Council has already apologised for the delay.

  • Bristol City Council (22 005 619)

    Statement Upheld Charging 11-May-2023

Summary: The Council failed to act proactively to consider what reasonable adjustments were required as part of a social care financial assessment in June 2019. As a result, Mr X who has learning difficulties and cannot read, attended alone and information was provided in writing. For subsequent financial assessments, the Council arranged for an advocate to assist Mr X. A suitable remedy for the uncertainty, distress and confusion caused is agreed.

  • Bristol City Council (23 000 704)

Statement Closed after initial enquiries Parking and other penalties 09-May-2023

Summary: We will not investigate Mr X’s complaint about a penalty charge notice issued by the Council. This is because it would have been reasonable for Mr X to use his right of appeal to the Traffic Penalty Tribunal.
