    Summary: Mrs D complained about the way the Trust cared for her father, Mr F, when he attended its emergency department and during two hospital admissions. She also complained about the way the Council and Trust dealt with her father’s discharge from hospital to a care home. We have found fault in the Council’s and Trust’s record keeping and in the way the Trust managed Mr F’s continence care. The Council and Trust accept our recommendations, so we have completed our investigation.

    Summary: Mr B complained about the way his relative, Mr C, was discharged from psychiatric liaison services on two occasions over one weekend. We found no fault by the Council, Livewell Southwest or the Trust.

    Summary: We found fault by Hill Care 3 Ltd as it failed to maintain accurate and complete nutritional records for Mr B, an elderly man at risk of malnutrition. We also found fault by the Trust as staff failed to inform Mr B’s family that his dentures were broken. Hill Care 3 Ltd and the Trust will apologise for this fault. We found no fault by the Council in terms of the care it provided to Mr B.

    Summary: We find fault with an NHS Trust and Council regarding the discharge planning process for the late Mr Y when he left hospital. The NHS Trust also failed to ensure Mr Y continued to receive treatment for a fungal infection. The Council failed to assess Mr Y’s care needs and its care provider failed to properly assess and meet Mr Y’s needs. The Council failed to properly investigate the safeguarding concern raised when Mr Y was readmitted to hospital and did not notify Mr Y’s daughter, Ms X, of the outcome. This meant Mr Y did not receive the care and support needed after his hospital discharge. The organisations have agreed to apologise to Ms X and make a symbolic payment to acknowledge the distress this caused her. The organisations have also agreed to take action to prevent a recurrence of the faults identified.

    Summary: Mr B complained the Trust and the Council delayed his late mother’s discharge from hospital and kept her in hospital against her will on two occasions in December 2019. Mr B said as a result his mother, Mrs C, contracted a hospital acquired infection and this contributed to her untimely death. We found no fault in the way the Trust dealt with Mrs C’s first discharge from hospital. We found fault in the way the Trust and the Council dealt with Mrs C’s second discharge, and this meant she remained in hospital for longer than she wanted. The faults caused avoidable distress and frustration to both Mrs C and Mr B. However, we cannot link the claimed injustice to the fault identified. To put things right the Trust and the Council have agreed to our recommendations and will improve their practice in line with the Mental Capacity Act 2005, apologise to Mr B and make an acknowledgement payment.

    Summary: Mrs D complained about flaws in her late mother, Mrs M’s, discharge from hospital and the care she received in her own home. Both the Council and the Trust acted with fault, which have led to uncertainty and distress for Mrs D. The Council and Trust have accepted our recommendations, so we have completed our investigation.

    Summary: We will not investigate Ms P’s complaint about the Council’s decision to not carry out an Education Health and Care needs assessment. This is because it would have been reasonable for Ms P to have used her appeal rights.

    Summary: The NHS Trust failed to involve the Council as soon as possible so that it could start care planning. This unnecessarily delayed Ms E’s discharge from hospital by three weeks. Ms E was schizophrenic; the prolonged hospital stay had an adverse impact on her mental health. Her mother, Ms D, was offering a lot of support. It was distressing for Ms D witnessing Ms E’s distress. Ms E has died so we cannot remedy her injustice. For the impact on Ms D over the avoidable three-week period, the NHS Trust will apologise and pay Ms D £600. The NHS Trust will also review its discharge policy.

    Summary: Mrs F has complained about a Trust and Council in relation to a child protection case involving her niece, Miss G’s child. I found fault with the Trust in obtaining an x-ray report from an unsuitably qualified radiologist. However, this fault did not lead to the injustice Mrs F has claimed and the Trust is making service improvements. In addition, I do not find fault with the Council’s actions.
