  • Transport for London (20 012 419)

Statement Closed after initial enquiries Other 31-Mar-2021

Summary: We will not investigate Mr X’s complaint about TfL’s failure to respond to his correspondence and complaints. This is because it is unlikely we would find fault causing Mr X significant injustice warranting our further involvement.

  • Kent County Council (20 012 562)

Statement Closed after initial enquiries Highway repair and maintenance 31-Mar-2021

Summary: We will not investigate Mrs B’s complaint about its duties under section 130 of the Highways Act 1980. This is because we cannot achieve the outcome she is seeking and it is not unreasonable to expect her to take the vehicle damage issue to court if it remains unresolved.

  • Transport for London (20 001 316)

Statement Upheld Parking and other penalties 31-Mar-2021

Summary: Mr Y complains about the process followed by Transport for London when it pursued him for an unpaid Penalty Charge Notice (PCN). The Authority has already acknowledged some fault and refunded the full cost of the PCN and fees paid by Mr Y. In our view this is a suitable remedy for the fault identified. However, the Authority will also apologise to Mr Y for the significant delay in responding to his complaint and inform us of the steps it is taking to improve the timeliness of its complaint handling.

  • North Yorkshire County Council (20 011 732)

Statement Closed after initial enquiries Highway repair and maintenance 31-Mar-2021

Summary: We will not investigate how the Council has dealt with the complainant’s concerns about the condition of the highway near his home. It is unlikely we would find evidence of fault and the complainant can seek a remedy in court.

  • London Borough of Hammersmith & Fulham (20 012 128)

Statement Closed after initial enquiries Traffic management 31-Mar-2021

Summary: We will not investigate Mr B’s complaint about a local traffic issue. This is because there was no requirement for the Council to consult the residents’ association about the experimental traffic order and we cannot yet say whether any fault by the Council in the way it is currently discussing the matter with residents has affected the permanent outcome for them.

  • London Borough of Tower Hamlets (20 012 253)

Statement Closed after initial enquiries Traffic management 31-Mar-2021

Summary: We will not investigate this complaint about the Council not taking parking enforcement action near his address. There is not enough evidence of fault by the Council, or of significant injustice to Mr C, to warrant investigation.

  • Sheffield City Council (20 011 981)

Statement Closed after initial enquiries Highway repair and maintenance 30-Mar-2021

Summary: We will not investigate Ms Q’s complaint about the Council’s failure to complete resurfacing works along her road. Nor will we investigate her complaint about the damage her car suffered because of the unfinished road surface. This is because she may go to court about both matters.

  • Northumberland County Council (20 011 797)

Statement Closed after initial enquiries Traffic management 29-Mar-2021

Summary: We will not investigate how the Council dealt with road safety concerns raised by the complainant for over six years. The complaint is made too late but investigation would not, in any case, achieve any different outcome. The Council has already addressed customer service issues arising from the complaint.

  • London Borough of Lewisham (20 011 870)

Statement Closed after initial enquiries Parking and other penalties 29-Mar-2021

Summary: We cannot investigate this complaint about a Penalty Charge Notice because the complainant appealed to the tribunal.

  • Devon County Council (20 007 223)

Statement Closed after initial enquiries Highway repair and maintenance 26-Mar-2021

Summary: Mr X complained the Council had failed to maintain the road outside his property and this meant he could not leave his property unaccompanied. Mr X also complained about the way the council handled his complaint. Mr X wanted the Council to fix the potholes. We will not exercise discretion to investigate this complaint as Mr X could go to court and it would be reasonable for him to do that.
