Statement Upheld Disabled facilities grants 23-Apr-2023
Summary: Ms X complains the Council failed to take appropriate action when she requested disability adaptations to her home. The Council is not at fault as it did not receive a referral for a disabled facilities grant for Ms X. The Council is at fault for the delay in responding to Ms X’s stage two complaint but this did not cause significant injustice to warrant a remedy from the Council.

Statement Upheld Council tax support 08-May-2023
Summary: Ms C complained about the way the Council dealt with her council tax account and claim for council tax reduction and its failure to make reasonable adjustments for her disabilities. Ms C says she has suffered avoidable recovery action and been put to unnecessary time and trouble which has had a harmful impact on her health. We have found fault by the Council but consider the agreed action of a symbolic payment provides a suitable remedy in addition to the explanation and apology already provided by the Council.

Tewkesbury Borough Council (23 002 834)
Statement Upheld Refuse and recycling 12-Jun-2023
Summary: We will not investigate Mr X’s complaint about the Council’s bin service, how it dealt with that complaint, and it not responding to a complaint about construction noise. There is not enough subsisting injustice caused to Mr X from the bin issues to warrant investigation. The Council’s payment offer is in line with the outcome we would have sought for the bin complaint and there is no different outcome investigation would achieve. We do not investigate council complaint-handling where we are not investigating the core issue giving rise to the complaint. It would not be unreasonable for Mr X to refer the construction noise complaint back to the Council for officers to investigate and reply.
