    Summary: Mr X complains a Coroner did not do her job properly. He says wrong information was read out in court and the hearing was not recorded. We cannot investigate the actions of the Coroner or what happened in court. The Council has apologised for failing to record the hearing. Further investigation on this point will not lead to a different outcome.

    Statement Upheld Highway repair and maintenance 13-Jul-2022

    Summary: We will not investigate this complaint that the Council reneged on an agreement to carry out works to unsafe trees. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. The Council has provided a satisfactory apology for wrongly telling the complainant it would undertake works, and there is insufficient evidence of fault in the way it reached the later conclusion that no works are necessary.

    Summary: Ms B has complained about the way the Council has assessed her son X’s contributions to his care and support package. There were some errors in the way the Council considered the assessments, but it has already taken appropriate action to remedy any injustice to X.

    Statement Upheld Special educational needs 11-Oct-2022

    Summary: Ms X complained the Council failed to ensure Z was provided with a suitable education or the support in his Education, Health and Care plan (EHC Plan) during various dates between September 2019 and February 2021 and failed to provide the personal budget which had been agreed. Ms X said this meant Z missed out on the education and support he was entitled to. The Council has already agreed there was a lack of provision at times. There was also delay in setting up Ms X’s personal budget which caused her frustration. The Council's offer of £1,200 is suitable to remedy the injustice she and Z experienced.

    Statement Upheld Fostering 26-Oct-2022

    Summary: Ms Y complains the Council failed to provide advice about her potential eligibility to receive benefit payments whilst providing long-term foster care for two children. The Council upheld some elements of the complaint, implemented some service improvements, apologised and offered to pay £900 for the distress caused. This is an appropriate remedy and we do not recommend anything further.

    Statement Upheld Special educational needs 26-Jan-2023

    Summary: Mrs X complains for her son Y there were failings and delays in the way the Council issued an amended Education Health and Care Plan following an annual review. And delays by the Council in paying Y’s personal budget causing stress and uncertainty. We have found service failure by the Council when dealing with Y’s Education Health and Care Plan. But this did not cause Y a significant injustice to warrant any further remedy than the apology already given by the Council. We found fault by the Council in making the personal budget payments. But this has not caused a significant injustice to Y as there has been no break in his service provision. So, we have completed our investigation.

    Statement Upheld Child protection 26-Mar-2023

    Summary: Mr X complained about the actions of the Council during a child protection investigation and assessment. Part of his complaint was upheld during the Council’s statutory complaints procedure. We have not found fault with how the Council considered his complaint. We found no further fault in its handling of the child protection investigation and are satisfied the Council’s remedy was proportionate and in line with our Remedies Guidance.
