    Summary: Mr C says the Council did not provide the care specified in his child’s education, health and care plan for seven months after the plan was agreed. The Council did not do so and was at fault. It has agreed to apologise to Mr and Mrs C and to CC, pay a sum to them in consideration of their distress and lost educational provision and inform the Ombudsman of its progress in improving its system.

    Statement Upheld Assessment and care plan 28-May-2019

    Summary: The Ombudsmen found fault with a Council and a CCG in delaying care and funding assessments. This did not cause an injustice to the individual receiving care. There was an injustice to the carer with delays in being able to access respite support but they do not wish to receive an apology from the Council. The Ombudsmen did not find fault with the care provided by the organisations or with decisions to use safeguarding procedures to consider concerns about an individual’s safety. The Ombudsmen found no fault by an NHS Trust about its role in providing care equipment.

    Statement Upheld Refuse and recycling 31-May-2019

    Summary: Ms B complains that when the Council changed its recycling scheme, it introduced a large bin which she does not want and will not use. The Council can specify what bin will be used and the implication in law and guidance is the resident will store the bin. There are no exceptional circumstances, and therefore the Council is not at fault. However, the Council served Ms B a formal notice in which the wording was unclear. The Council will apologise and review the wording of future notices.

    Statement Upheld Street furniture and lighting 13-Jun-2019

    Summary: Mr X complains about high levels of light intrusion from a street lamp positioned outside his mother’s (Mrs Y’s) property. He says this causes her distress. He also complains about delays in the Council’s complaints process. The Council took appropriate action to reduce the level of light intrusion to within the recommended limits. However, there was some delay within the process. It has agreed to apologise to Mr X and his mother for the delay and pay Mrs Y £150 to acknowledge the distress caused.

    Statement Upheld Housing benefit and council tax benefit 02-Jul-2019

    Summary: Ms Y complained about Council errors in her benefits payments, which it then asked her to repay. She also complained about the Council’s poor communication about the issue. We uphold Ms Y’s complaint. The Council made errors in handling her council tax support and housing benefit claims. These caused Ms Y upset, confusion and inconvenience. To remedy this the Council have agreed to give Ms Y a clear statement of where her situation now stands and confirm it will not seek to recover the discretionary housing payment of £200.

    Summary: The Council properly investigated planning enforcement concerns on a development. However, it did not handle the complainant’s complaints about these matters properly, causing limited injustice. The Council agreed an apology to remedy this and a review of the Council’s complaints information.

    Summary: Mrs X complained about the Council’s decision to remove her housing priority. The Council has now reinstated Mrs X’s housing priority and so we are discontinuing our investigation.

    Statement Upheld Child protection 30-Jul-2019

    Summary: Mr X complains that on two occasions the Council wrongly applied a red flag against his name on their care record system, indicating he posed a risk to children. He says this has caused him distress, affected his family life and he has lost trust in the Council’s ability to maintain accurate records. The Council has accepted fault but the remedy it offered Mr X is insufficient for the injustice caused. Due to the repeated nature of the mistake and distress caused, the Council has agreed to pay Mr X £300. Mr X also complains the Council are still saying he presents a risk to children, but there is no evidence of this.

    Statement Upheld Special educational needs 31-Jul-2019

    Summary: The Ombudsman upholds Mr X’s complaint about the delay in finalising an Education, Health and Care Plan for his son, C. The Council missed three opportunities to consider whether to assess C. Once it decided to asses, the Council took twice as long as it should have to issue the plan and this meant C missed out on provision. To remedy the injustice caused, the Council will apologise to Mr X and C and pay £1,600 to account for C’s lost provision. It will also make a payment to Mr X for the lost opportunity to appeal against the Council’s decision not to assess C, and for his time and trouble in making the complaint. Finally, the Council will ensure it keeps draft copies of plans issued to parents; reminds staff of the process of early referral for a needs assessment; and reminds schools about the correct process for excluding children from school. There was no fault by the Council in ensuring C received full-time education.

    Statement Upheld Special educational needs 08-Aug-2019

    Summary: Mrs X complained about the Council’s delay in reviewing her daughter’s Education, Health and Care plan, and issuing a final amended plan. The Council is at fault for the delays. It should apologise and pay Mrs X £300 for her time and trouble pursuing this. Her daughter has not missed out on support as a result of the delay.
