    Summary: Ms X complained about the Council’s handling of her housing situation after she received an eviction notice. We found the Council at fault for not finding interim accommodation when it should have and for delays in accepting the relief duty to her. The Council has provided Ms X with an apology and a symbolic payment to recognise her distress. We are satisfied this is appropriate to remedy the personal injustice caused and the Council has also taken action to prevent future recurrence of the faults.

    Summary: Mrs X complained about how the Council allocated a property to another applicant after Mrs X successfully bid for the vacant property which the Council invited her to view. There were faults by the Council which caused injustice to Mrs X. The Council will take action to remedy the injustice caused.

    Summary: Ms X complained the Council has incorrectly assessed Mr Y’s priority on the housing register and failed to carry out a banding review. The Council delays in considering Mr Y’s request for a reassessment of his banding on the housing register is fault. As is the delay in responding to Ms X’s complaint. These faults have caused Mr Y and Ms X an injustice.

    Summary: Mr X says the Council ended his interim accommodation agreement unfairly. He also says it closed his homelessness application by referring it to another Borough who cannot help him. Mr X says his belongings were also stolen from his interim accommodation. Mr X says this has caused him distress. We have found fault in the Council’s actions for failing to discuss the issues Mr X raised with his interim accommodation with him before ending his agreement. The Council has agreed to issue an apology, pay a financial payment to Mr X and make service improvements.

    Summary: Miss X complained about the Council’s actions regarding her temporary homeless accommodation, linked to costs of running a dehumidifier at one property and the suitability of a second property she later moved to. There was evidence of fault in the condition of the first property. The Council has already apologised and made payments to Miss X for electricity costs and to remedy the injustice caused by the issues. There was no fault in how the Council conducted a suitability review on the second property. I am satisfied any injustice to Miss X has already been remedied.

    Statement Upheld Special educational needs 11-Nov-2024

    Summary: There was delay by the Council issuing Y’s first Education, Health and Care Plan after the law changed in 2018. This caused avoidable uncertainty. There was also delay securing educational provision on the post-Tribunal Plan of December 2023 which caused Y a loss of educational provision. The Council offered a payment of £18,023 to remedy the loss of educational provision. This is an appropriate remedy for Y’s injustice. The Council will also apologise to Ms X and make her a payment of £150 to reflect the avoidable distress.

    Summary: Miss X complains about how the Council dealt with her homelessness application. The Council was at fault as it failed to offer interim accommodation when Miss X first made her homelessness application, placed her in unsuitable interim accommodation, delayed in accepting the main housing duty and failed to properly investigate her complaint. These faults caused harm and distress to Miss X which the Council has agreed to remedy by apologising and making a symbolic payment of £2000 to her.

    Summary: We will not investigate this complaint about the Council sharing Miss X’s personal information. The Information Commissioner’s Office is best placed to deal with complaints about data protection. If we considered the complaint, we could not achieve a higher financial remedy than the Council has already offered, and the courts are best placed to consider compensation claims.
