    Summary: We found fault on Mr J’s complaint about the Council’s use of enforcement agents. Its failures to act on a notification by the Valuation Tribunal about a hearing, and a further failure to provide it with full documentation, led to the delay of the hearing by 8 months. The agreed action remedies the injustice caused.

    Summary: The Council was at fault for failing to consider the impact of incidents of domestic abuse when deciding Ms X’s priority for rehousing. The Council was also at fault for having an unclear policy for assessing Ms X’s housing need resulting from overcrowding. This led Ms X to believe she was in the wrong priority band. The Council has agreed to apologise, award the higher priority to Ms X and others affected, make a payment to Ms X, and act to improve its services.

    Summary: Mrs X complained about the Council’s decision to refuse business rates relief and its complaint handling, causing financial loss and distress. We found no fault in the Council’s decision making but we found fault in its complaint handling. We recommended the Council provides an apology to Mrs X, pays her £100 for time and trouble and acts to prevent recurrence.

    Summary: The Council took too long to organise the Occupational Therapist assessment. However, this did not alter the outcome of the housing application, which the Council properly considered. There was also fault in the Council’s complaint handling but again this did not alter the outcome.

    Summary: We will not investigate this complaint about the Council’s handling of Mr X’s Education, Health, and Care needs assessment and plan. This is because the Council has agreed to resolve the complaint early by providing a proportionate remedy for the injustice caused by the fault accepted. We will not investigate the rest of Mr X’s complaints because it is reasonable for him to use his right of appeal to the SEND Tribunal.

    Summary: There was fault by the Council, because it did not explain properly its decision about the position and maintenance of a boundary fence, and because it did not properly consider reports of anti-social behaviour the complainant made. To remedy the uncertainty and frustration this has caused, the Council has agreed to write to the complainant to clearly explain its decisions about these matters, and to offer a symbolic financial remedy.

    Summary: Mrs X complained there have been significant delays in providing her son, Mr Y with a working step lift to enable him to access and exit his home independently. The Council’s delays and failure to ensure Mr Y had a working lift that met his needs so that he could enter and exist his home independently are fault. This fault has caused Mr Y and Mrs X an injustice.

    Statement Upheld Special educational needs 02-Nov-2023

    Summary: On behalf of Mrs X and her child B, Mrs H complains the Council has failed to secure the therapy provision in B’s EHC Plan since the 2022/23 academic year. We have found the Council at fault for failing to secure the Speech and Language Therapy (SALT) and Occupational Therapy (OT) provision specified in B's EHC Plan. We have also found the Council at fault for failing to properly address or respond to concerns about B’s provision. We have made recommendations to remedy the injustice this has caused B. We have also recommended the Council act to improve its services.
