    Summary: Mr X complained about the Council’s failure to provide his son, Y, with educational provision in line with his Education, Health and Care (EHC) plan between July 2021 and July 2022 after Y moved to the Council’s area. The Council was at fault for failing to provide any educational provision for 17 weeks, and for only providing some provision for 7 weeks. The Council will pay Mr X £2,250 for the benefit of Y’s education and socialisation. It will also pay Mr X £300 to recognise the distress caused to him.

    Summary: Mrs M complained her son, B, was without education between June 2021 and November 2022. The Council recognised it should have arranged alternative tuition sooner. I have recommended a remedy for the injustice caused by the delay. The Council agreed to include information from specialist assessments in B’s Education, Health and Care (EHC) Plan when they are available. This is an appropriate response.

    Statement Upheld Parking and other penalties 08-May-2023

    Summary: Mr B complained that the Council failed to advise him correctly about whether the property he was purchasing would be eligible for a parking permit. Less than a month after Mr B enquired, the Council introduced a change to the rules which meant the property would not be eligible for a parking permit. Mr B only discovered this two years later when he tried to obtain one. We found the Council should have advised Mr B about the imminent change. We consider this caused him frustration and raised expectation that he would be able to obtain a parking permit. The Council has agreed to pay Mr B £150.

    Summary: We will not investigate Ms X’s complaint about the Council’s handling of its review of her daughter’s Education Health and Care Plan. This is because the Council has offered a suitable remedy and it is therefore unlikely we could achieve anything more for Ms X.

    Summary: Mr X complained about the action of children’s services between June and October 2022. We upheld the complaint finding the Council missed a series of opportunities to review an initial decision not to assess his daughter as a potential child a need. It also failed to communicate effectively with Mr X. These faults caused him unnecessary distress. The Council accepts these findings and at the end of this statement we set out the action it has agreed to remedy that injustice and make service improvements.

The Council is at fault for failing to communicate to Mrs X the actions it had taken in response to her complaint. The Council is also at fault for overlooking a key piece of information that resulted in a delay in reimbursing costs to Mrs X. The Council has made service improvements and it has agreed to remedy the outstanding personal injustice to Mrs X.

    Summary: Mrs X complained about how the Council stopped her special guardianship allowance in respect of her grandchild, Y, and the Council’s lack of communication with her. There were some faults by the Council which caused injustice to Mrs X. The Council will take action to remedy the injustice caused.

    Summary: Mr Z, on behalf of Ms X, complained the Council failed to provide her appropriate help and support to complete a financial assessment and did not include disability related expenditure in the assessment. While there is no fault in the assessment process there has been fault in the consideration of the disability related expenditure. To remedy this fault the Council will conduct a review and make a new decision.
