The complaint

  1. Mr X complains the introduction of a controlled parking zone near his home has resulted in cars now parking along his road. He says these cars block residents’ driveways and cause obstructions, so that ambulances cannot get through and the Police often have to be called.
  2. Mr X thinks a parking scheme needs to introduced in his road too.

The Ombudsman’s role and powers

  1. The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
  2. We cannot investigate complaints about the provision or management of social housing by a council acting as a registered social housing provider. (Local Government Act 1974, paragraph 5A schedule 5, as amended)
  3. Similarly, we cannot investigate complaints about the management of housing let on a long lease by a council that is a registered social housing provider. (Local Government Act 1974, paragraph 5B, schedule 5, as amended)
  4. The law also says we cannot normally investigate a complaint when someone has a right of appeal, reference or review to a tribunal about the same matter. However, we may decide to investigate if we consider it would be unreasonable to expect the person to use this right. (Local Government Act 1974, section 26(6)(a), as amended)
  5. London Tribunals considers parking and moving traffic offence appeals for London.
  6. Finally, we provide a free service but must use public money carefully. So, we may decide not to start or continue with an investigation if we are satisfied with the actions an organisation has taken or proposes to take. (Local Government Act 1974, section 24A(7), as amended)
