We must also consider whether any fault has had an adverse impact on the person making the complaint, which we call ‘injustice’. We provide a free service but must use public money carefully. We do not start or continue an investigation if we decide there is not enough evidence of fault to justify investigating (Local Government Act 1974, section 24A(6), as amended, section 34(B))

My assessment

  1. Mrs X complained to the Council about a streetlight outside her home which she said was too bright and prevented her from sleeping.
  2. The Council made several visits and reduced the brightness. It also fitted a shield. It ensured the light is working properly.
  3. I will not investigate this complaint as the Council has taken action to reduce the impact of the streetlight, and there is not enough evidence of fault to justify an investigation.
