The Ombudsman's final decision:
Summary: We cannot investigate this complaint about a parking penalty charge notice. Mr X appealed it to the independent tribunal and the matter is therefore no longer within our legal remit.
The complaint
- Mr X complains the Council unfairly issued him with a parking penalty charge notice (PCN) and that it did not disclose information to the Traffic Penalty Tribunal (TPT) that would have supported Mr X’s appeal against the PCN.

- We cannot investigate a complaint if someone has appealed to a tribunal about the matter. (Local Government Act 1974, section 26(6), as amended)

My assessment
- Since Mr X used his right of appeal to the TPT, we can no longer investigate.
- Mr X would need to take up his concerns about the Council’s input into the appeal with the TPT.
Final decision
- We cannot investigate Mr X’s complaint because it is no longer within our remit since Mr X appealed the PCN to the TPT.
