Birmingham City Council (24 006 115)
Category : Transport and highways > Other
Decision : Closed after initial enquiries
Decision date : 13 Aug 2024
The Ombudsman's final decision:
Summary: We will not investigate this complaint about damage caused to the complainant’s car as his repair costs have been met and there are not grounds for our further involvement.
The complaint
- Mr X complained that the Council had not met his claim for repair costs after his car was damaged by a Council contractor.
The Ombudsman’s role and powers
- It is our decision whether to start, and when to end an investigation into something the law allows us to investigate. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
- I considered information provided by the complainant.
- I considered the Ombudsman’s Assessment Code.
My assessment
- After making his complaint, Mr X updated us to say the Council’s contractor had agreed to pay for the repairs to his car.
- As such, there are not grounds for our further involvement, and we will not therefore investigate.
Final decision
- We will not investigate Mr X’s complaint because it has been resolved.
