The Ombudsman's final decision:
Summary: We will not investigate this complaint about the Authority not dealing with Miss X’s request to resolve her issues, relating to a speed camera. The matter she complained about is not an administrative function of this Authority.
The complaint
- Miss X complained because the Council would not accept it was responsible for road markings alongside a speed camera. It also said it was not responsible for the maintenance of this camera.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate complaints about actions which are not the administrative function of a council. (Local Government Act 1974, section 26(1) as amended).

- I considered information provided by the complainant and I considered the Ombudsman’s Assessment Code.
My assessment
- Miss X complained about issues relating to a speed camera, including faulty road markings and a fault with the camera. The Authority said it was not responsible for these matters.
Final decision
- We will not investigate Miss X’s complaint because it does not relate to an administrative function of this Authority.
