Decision : Closed after initial enquiries
Decision date : 03 Apr 2023
The Ombudsman's final decision:
Summary: We will not investigate this complaint about the way the Council dealt with a planning application because the complaint has been made on behalf of a Parish Council.
The complaint
- Mr X, a member of the Parish Council, complains that the Council failed to properly take into account their comments on a planning application.
The Ombudsman’s role and powers
- We cannot investigate complaints from public bodies. (Local Government Act 1974, section 27(1)(a), as amended)
How I considered this complaint
- I considered information provided by the complainant.
- I considered the Ombudsman’s Assessment Code.
My assessment
- A planning application for a number of dwellings was made in June 2022. Mr X complains on behalf of the Parish Council about the way the Council dealt with the matter.
- However, the Ombudsman cannot investigate complaints made on behalf of public bodies such as Parish Councils. The complaint is therefore out of jurisdiction.
