Summary: We will not investigate this complaint about how the Council dealt with a planning application. This is because we are unlikely to find fault.

The complaint

  1. The complainant, whom I shall refer to as Mr X, has complained about how the Council dealt with a planning application for a development near his home. He says the Council failed to properly consider the impact the development would have on his amenity and the new extension causes a significant loss of privacy.

The Ombudsman’s role and powers

  1. The Ombudsman investigates complaints about ‘maladministration’ and ‘service failure’, which we call ‘fault’. We must also consider whether any fault has had an adverse impact on the person making the complaint, which we call ‘injustice’. We provide a free service, but must use public money carefully. We do not start or may decide not to continue with an investigation if we decide:
  • there is not enough evidence of fault to justify investigating, or
  • there is another body better placed to consider this complaint.

  1. We cannot question whether a council’s decision is right or wrong simply because the complainant disagrees with it. We must consider whether there was fault in the way the decision was reached. (Local Government Act 1974, section 34(3), as amended)
  2. We normally expect someone to refer the matter to the Information Commissioner if they have a complaint about data protection. However, we may decide to investigate if we think there are good reasons. (Local Government Act 1974, section 24A(6), as amended)

My assessment

  1. When a local authority receives a planning application it must look at the development plan and material planning considerations to decide if the proposal is acceptable. Material considerations relate to the use and development of the land in the public interest and includes matters such as the impact on neighbouring properties and the relevant planning policies. It is for the decision maker to decide the weight to be given to any material considerations in determining a planning application.
  2. The Ombudsman does not act as an appeal body for planning decisions. Instead, we consider if there was any fault with how the decision was made.
  3. In this case, I am satisfied the Council properly assessed the acceptability of the development, including the impact on neighbouring properties, before granting planning permission. The case officer’s report said the development would not have an adverse impact on neighbouring properties in terms of overlooking or loss of privacy.
  4. Mr X says the case officer failed to visit the site and therefore did not properly assess the impact the development would have on his property. He is also concerned his neighbour may convert a flat roof into a sundeck. However, the applicant is required to build the development in line with the approved plans. Councils are not obliged to carry out site visits before deciding on a planning application. Officers will often already have local knowledge of an area and be able to identify the impact of a proposed development using ariel photographs and other tools. In this case, the Council has explained how it was able to determine the application without visiting the development site.
  5. I understand Mr X disagrees with the decision to grant planning permission. But the Council was entitled to use its professional judgment to decide the application was acceptable and the Ombudsman cannot question this decision unless it was tainted by fault. As the Council properly considered the application, it is unlikely I could find fault.
  6. Mr X has also complained about how the Council dealt with his Freedom of Information request and says it has refused to provide all the information he asked for. Mr X can complain to the Information Commissioner’s Office (ICO) if he is concerned about how the Council dealt with his request for information. The ICO is the independent body set up to uphold information rights and is best placed to deal with Mr X’s concerns in this regard.
  7. Mr X has also complained about the Council’s complaint handling. However, where the Ombudsman has decided not to investigate the substantive issues complained about, we will not usually use public resources to consider more minor issues such as complaint handling.
