The Ombudsman's final decision:
Summary: Mr X complains that the Council has not extended parking restrictions on a road junction. The Ombudsman will not investigate this complaint because the matter is out of time.
The complaint
- Mr X complains that the Council has not extended parking restrictions on a road junction.
The Ombudsman’s role and powers
- We cannot investigate late complaints unless we decide there are good reasons. Late complaints are when someone takes more than 12 months to complain to us about something a council has done. (Local Government Act 1974, sections 26B and 34D, as amended)
How I considered this complaint
- I have considered the comments of the complainant and the Council and the complainant has had an opportunity to comment on the draft decision.,
What I found
- Mr X says that he has campaigned to the Council for the provision of yellow lines on a junction near his house. Mr X says the Council agreed to this and painted yellow lines on the road three years ago. Mr X says that they do not go far enough and the junction remains dangerous.
- The Ombudsman would reasonably expect a complaint about the restricted yellow lines to have been made to this office within a year of the date the yellow lines were painted on the road. The matter is therefore out of time.
