Summary: Mr X complains about the Council’s grant of planning permission for a nursery in 2016. We will not investigate this complaint because the complaint is out of time.

- Mr X complains about the Council’s grant of planning permission for a nursery in 2016.
The Ombudsman’s role and powers
- We cannot investigate late complaints unless we decide there are good reasons. Late complaints are when someone takes more than 12 months to complain to us about something a council has done. (Local Government Act 1974, sections 26B and 34D, as amended)

- I considered information provided by the complainant and the Council.

- The complainant had an opportunity to comment on my draft decision.
My assessment
- Mr X says that when the Council considered a planning application for a Certificate of Lawfulness in 2016 it should have placed conditions of operation to protect neighbouring amenity.
- Any dissatisfaction with the Council’s decision regarding this decision could, reasonably, have been made to this office within 12 months of 2016. The complaint is therefore out of time.
