Summary: We will not investigate this complaint about the data the Council holds about the complainant. It would be reasonable for the complainant to refer the matter to the Information Commissioner’s Office which is best placed and has legal authority to handle it.
The complaint
- Mr Y says the Council refuses to correct the data it holds about him which it received from the police.
The Ombudsman’s role and powers
- We normally expect someone to refer the matter to the Information Commissioner if they have a complaint about data protection. However, we may decide to investigate if we think there are good reasons. (Local Government Act 1974, section 24A (6), as amended)

- The issue Mr Y is complaining about is about data protection.
- Therefore, it would be reasonable for Mr Y to complain to the Information Commissioners Office (ICO).
- The ICO considers matters regarding data protection and the collection and storage of data.
Final decision
- We will not investigate Mr Y’s complaint because it would be reasonable for him to refer the matter to the Information Commissioners office.
