Summary: Mrs X complains the Council has failed to respond to the subject access request she has made for all data held about her and her family. The Information Commissioner’s Office is best placed to deal with this matter and so the Ombudsman will not investigate.
The complaint
- Mrs X complains the Council has not responded to the subject access request she has made to be provided with copies of all data the Council holds about her and her family.
The Ombudsman’s role and powers
- We normally expect someone to refer the matter to the Information Commissioner if they have a complaint about data protection. However, we may decide to investigate if we think there are good reasons. (Local Government Act 1974, section 24A(6), as amended)
How I considered this complaint
- I have considered what Mrs X said in her complaint and I have sent her my draft decision on it for her comments. Mrs X made no further comment.
What I found
- Mrs X complains the Council has not responded to the subject access request she has made to be provided with copies of all data the Council holds about her and her family.
- The Information Commissioner’s Office (ICO) is the UK’s independent authority set up to uphold information rights and rule on data protection matters. It is best placed to deal with Mrs X’s complaint. We will not therefore investigate.
Final decision
- My decision is that the Ombudsman will not investigate this complaint. This is because the ICO is best placed to deal with this matter.
