Summary: The Ombudsman has no jurisdiction to consider this complaint about the conduct of proceedings in a court of law.
The complaint
- The complainant, who I refer to here as Mr B, has complained about issues relating to civil proceedings he has taken against the Council.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate. It says we cannot investigate a complaint about the conduct of proceedings in a court of law. We have no discretion in this. court. (Local Government Act 1974, Schedule 5/5A, paragraph 1/3, as amended)

- I have considered what Mr B said is his complaint and background information provided by the Council.
Final decision
- I have decided not to investigate this complaint. It is clearly about proceeding in a court of law and so we have no jurisdiction to consider it.
