    Summary: Miss E complained the Council failed to secure alternative education provision, after her child could not attend school from January 2024 onward. We upheld the complaint finding the Council did not properly consider her child’s need for alternative provision before November 2024, when it provided an Education, Health and Care Plan. We considered that if it had done so, it would have made such provision. The Council has accepted these findings. At the end of this statement, we set out the action it has agreed to remedy the injustice caused to Miss E as a result and to improve its service.

    Summary: Mrs X complained the Council delayed issuing her child’s education, health and care (EHC) Plan and it failed to provide her with an education when she was unable to attend school. We found the Council at fault for delays in finalising the EHC Plan and arranging a suitable education. The faults caused a loss of education and avoidable distress. The Council has agreed to remedy the injustice caused by apologising in writing and providing a payment to the family.

    Summary: The Council failed to review and issue Mr X’s son, Z’s, Education, Health and Care Plans on time. It also failed to plan for the support Z would need when he started post-16 college. This meant Z missed key support he needed during his GCSE year of school, he had no record of his needs as his physical disability progressed and he avoidably missed out on post-16 education. The Council’s faults also caused Z and Mr X avoidable frustration, distress and uncertainty. To recognise the injustice caused, the Council has agreed to apologise, pay Mr X and Z £2,500 and take action to improve its services.

    Summary: Mrs B complained the Council failed to provide her with the right banding on its housing register and refused to consider transferring her to another property. Council has reviewed the case and awarded the right banding, backdated that banding and paid Mrs B £100. The Council is also actively seeking a new property for Mrs B. There is nothing further the Ombudsman can achieve for Mrs B.

    Summary: During two earlier investigations, we identified that faults in the way the Council was operating its children’s statutory complaints procedure were potentially causing injustice to others. We opened this new complaint to investigate. We found that complainants have experienced delay, and in some cases, have been denied their right to access the full complaints procedure.

    Summary: We will not investigate this complaint about charging for adult social care. Although there was delay by the Council, it has backdated charges to the correct start date and apologised for its delay in resolving the issue. We are satisfied with the Council’s actions to resolve the complaint, and it is unlikely an Ombudsman investigation would lead to a different outcome.
