Statement Closed after initial enquiries Other 15-Dec-2025

Summary: We will not investigate Mrs B’s complaint about damage to her property. This is because it is not our role to decide negligence claims and the alleged injustice is not significant enough to justify our involvement.

  • Wokingham Borough Council (23 016 994)

Statement Upheld Special educational needs 15-Dec-2025

Summary: There was a two-and-a half month delay issuing Y’s final Education, Health and Care Plan, causing a delay in appeal rights. There was delay arranging alternative educational provision for her from April 2023. This caused a loss of alternative educational provision between April and September 2023. There was also a failure to consider Ms X’s request for tuition in January 2023 which caused avoidable uncertainty. The Council will make payments and apologise. It will also finalise and implement its policy about the duty in section 19 of the Education Act 1996.

Mr M says he feels unsafe in his own home and is unable to have visitors. He considers the Council should evict the neighbour and ensure he receives care appropriate to his needs.

The terms and conditions in the contract provided by the Care Provider were not transparent which caused injustice as the annual increases were not clear. Mr X’s mother did not pay above the standard annual increase so there was no financial injustice. The Care Provider has amended the terms and conditions to remedy the injustice.

We found no fault in the process the Council followed to reach its decisions on the substantial matters complained about. It therefore reached decisions it was entitled to make. There was some fault relating to a review meeting and delayed complaints handling. The Council will apologise to acknowledge the impact this had on Mr X and Ms Y.
