Summary: We cannot investigate this complaint about disrepair to Ms X’s neighbouring property as this matter is not within our legal remit.
The complaint
- Ms X complained that the leaking gutter on her neighbouring property, which is owned by the Council, is causing water damage to her property. Ms X wants the Council to carry out repairs to fix the problem.

- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate complaints about the provision or management of social housing by a council acting as a registered social housing provider. (Local Government Act 1974, paragraph 5A schedule 5, as amended)

- The property in question is part of the Council’s social housing stock. This is a complaint therefore about the Council’s management of its social housing and as per paragraph three, we cannot investigate.
