The Ombudsman's final decision:
Summary: We will use our discretion not to investigate this complaint about temporary accommodation because the complainant’s circumstances have changed.
The complaint
- The complainant, Ms X, complained about her temporary accommodation.
The Ombudsman’s role and powers
- It is our decision whether to start, and when to end an investigation into something the law allows us to investigate. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
- I considered information provided by Ms X and the Council. This includes the complaint correspondence and updates from the Council and Ms X. I also considered our Assessment Code.
My assessment
- Ms X complained about the condition of her temporary accommodation and said it was too small.
- Since complaining to us Ms X has left the property and is staying with family. She asked the Council to discharge its homelessness duty to her.
Final decision
- We will not investigate this complaint because Ms X’s circumstances have changed and she said she did not want to continue with the complaint.
