Summary: Mrs S complains the Council did not arrange alternative educational provision for her daughter after she became unwell and unable to attend school. It also delayed completing her Education, Health and Care needs assessment. Mrs S says the Council’s fault meant X missed out on suitable educational provision for a year and has not received special educational needs support she may have been entitled to. We uphold the complaint. The Council has agreed to our recommendations.

Summary: Mrs B complained that the Council in approving a planning application for development next to her property, failed to properly consider the impact on her amenity relying on the existence of a boundary fence which the neighbour has now removed. We found some fault in the way the Council explained the reasons for its decision, but we consider the action taken afterwards has resolved the situation.

Summary: X complained about the Council’s decision not to take enforcement action against a landowner, who is alleged to have unlawfully felled trees protected by a Tree Preservation Order. We completed our investigation because we found no fault in the way the Council made its decision.

Summary: Mr X complained the Council delayed completing his daughter Y’s Education, Health and Care (EHC) needs assessment in line with statutory timescales. The Council was at fault because it failed to decide whether to issue Y with an EHC Plan within the statutory timescales, caused by a delay in obtaining Educational Psychologist advice. The Council has agreed to apologise and make a payment to Mr X to acknowledge Y’s lost provision and the distress, frustration and uncertainty this caused him.

Summary: Mrs X complained about the Council’s delays with completing her children’s Education, Health and Care needs assessments, its delays with issuing their final Plans and with its complaint handling. Mrs X also complained the Council did not provide her children with alternative provision. There were some faults by the Council which caused injustice to Y, Z and Mrs X. The Council will take action to remedy the injustice caused.
