Sandwell Metropolitan Borough Council (19 006 851)
The Ombudsman's final decision:
Summary: The Ombudsman has discontinued his investigation into Mr X’s complaint about the Council cutting down trees in his garden. Mr X says this has now been resolved.
The complaint
- The complainant, whom I shall refer to as Mr X, complains the Council cut down trees in his garden. Mr X initially asked the Council to remove the tree stumps and remove the rubble left in his garden.
The Ombudsman’s role and powers
- We can decide whether to start or discontinue an investigation into a complaint within our jurisdiction. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
- I have considered what Mr X said in his complaint. I sent a draft of this decision to Mr X and the Council for comments.
What I found
- Mr X complained to the Council as it removed trees in his garden which acted as a boundary with a council property.
- Mr X complained to the Council. He asked it to reinstate the boundary fence between his property and the tenants, remove the stumps of the trees and remove the debris left in his garden.
- The Council reinstated the fence but did not remove the stumps or debris.
- Mr X complained to the Ombudsman. After making his complaint to us, Mr X confirmed the problem had been resolved to his satisfaction.
Final decision
- I have discontinued my investigation as Mr X confirmed the matter is resolved.
