East Hampshire District Council (22 000 952)
Category : Environment and regulation > Refuse and recycling
Decision : Closed after initial enquiries
Decision date : 16 May 2022
The Ombudsman's final decision:
Summary: We will not investigate this complaint about missed garden waste collections and the Council’s handling of Mr X’s complaint about this as the Council is still dealing with this matter.
The complaint
- Mr X complains about ongoing missed garden waste collections and that the Council has not properly responded to his complaint from August 2021. Mr X wants a refund or an extension to his garden waste subscription and a financial payment for the time and trouble he has spent dealing with this problem.
The Ombudsman’s role and powers
- We can decide whether to start or discontinue an investigation into a complaint within our jurisdiction. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
- I considered information provided by the complainant and the Council.
- I considered the Ombudsman’s Assessment Code.
My assessment
- The Council has acknowledged to me that it did not properly respond to Mr X’s complaint but that a response is now being compiled which should address Mr X’s concerns. If Mr X remains dissatisfied after receiving this, it is open to him to complain to us again.
Final decision
- We will not investigate Mr X’s complaint because the Council is still dealing with this matter.
