Summary: Mr X complains about the Council’s handling of parking and vehicle management issues on the housing estate in which he lives. The Ombudsman cannot investigate the complaint because it falls under the jurisdiction of the Housing Ombudsman Service and Mr X should make his complaint to that service.
The complaint
- The complainant, who I refer to as Mr X, complains about the Council’s handling of parking and vehicle management issues on the housing estate in which he lives. He says he has been deprived of parking and related services which form part of his housing agreement.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate complaints about the provision or management of social housing by a council acting as a registered social housing provider. (Local Government Act 1974, paragraph 5A schedule 5, as amended)
How I considered this complaint
- In considering the complaint I spoke to Mr X and reviewed the information he provided.
What I found
- Mr X lives on a Council housing estate and has complained to the Council about parking and vehicle management issues on the estate but he is not satisfied with its response to his complaint.
Assessment
- The issues Mr X has raised in his complaint fall under the jurisdiction of the Housing Ombudsman Service and cannot be investigated by our Ombudsman service.
Final decision
- The Ombudsman cannot investigate this complaint as it falls under the jurisdiction of the Housing Ombudsman Service and Mr X should make his complaint to that service.
