He says the Council failed to consult with residents and it failed to comply with the Code of Practice for Environmental Noise Control at Concerts. He also says the Council failed to act on illegal noise levels after 11pm. We do not find the Council was at fault.

We have found fault by the Council in failing to respond to X’s further noise complaint following the closure of the initial complaint, causing injustice. The Ombudsman’s decision is the Council has taken reasonable steps to investigate Mrs D’s concerns, which is what it is required to do by the Environmental Protection Act. So we cannot question the merits of the Council’s view the noise its officers witnessed did not amount to a statutory nuisance.

Summary: Mr B complains the Council has not taken enforcement action against a neighbouring business for breach of planning enforcement notices and statutory nuisance. He says the there are regular fires, excessive noise and toxic fumes coming from the business, which have a significant impact on people living close by. At this stage, we find the Council is at fault in how it carried out its planning enforcement and environmental health investigations and communicated its findings to Mr B.
