    Summary: Mr X complained about the Council’s delay in carrying out a care assessment for his mother, Mrs Y, which he says led to a decline in her physical and mental health. Mr X says the matter has caused his family distress and frustration and they are being pursued for unpaid care fees. He would like an independent investigation, a financial remedy to cover the cost of Mrs Y’s care fees, and oversight to prevent similar failures in future. We will not investigate this complaint. It is unlikely we would reach reliable conclusions due to the passage of time, or achieve a meaningful outcome for Mr X.

    Summary: There was fault in the way the Council considered an application for home to school transport made on the grounds of special educational needs and disability. The Council delayed carrying out an individual assessment of the child’s ability to walk the distance required, wrongly relying on an expectation the parent drive the child. As a result, transport support was delayed, causing distress, inconvenience and expense to the parent. The Council has agreed to refund Ms X’s mileage, make a symbolic payment for the distress and inconvenience caused and make service improvements.

    Summary: Mr Y complains the Council failed to replace a psychologist despite having agreed to provide Mr X with one indefinitely and delayed completing a care assessment. The Council failed to explain why the psychology input had ended and it delayed completing a care assessment. That caused Mr Y and his wife distress. An apology, payment to Mr Y and provision of an action plan to address the backlog of care assessments is satisfactory remedy.

    Summary: We cannot investigate if the Council was at fault for failing to ensure Miss X’s child Y received the special educational provision outlined in their Education, Health and Care Plan, as it was too closely connected to her reason for appealing to the Tribunal. There was fault in the Council’s communication and complaint handling for which it has offered a suitable financial remedy during our investigation for the frustration caused. The Council was also at fault for failing to send its decision within four weeks of Y’s annual review meeting however this fault did not cause a significant injustice.

    Summary: Miss D complains TFL incorrectly changed the status of her vehicle to non ULEZ compliant and delayed responding to her complaint. There is fault in respect of complaint handling but no fault regarding the compliance issue. TFL has already offered a reasonable remedy to Miss D for the complaint handling.

There is evidence the organisations have tried to adapt to meet Ms A’s needs and have offered a range of services to support her.
