  1. We cannot investigate a complaint about the start of court action or what happened in court. (Local Government Act 1974, Schedule 5/5A, paragraph 1/3, as amended)

My assessment

  1. Mr X says a Council social worker has provided a court with a biased report ignoring vital evidence and information he gave. He says the officer gave poor oral evidence to a Court. He says this means he has not seen his children.
  2. We cannot investigate the content or preparation of reports Council officers have given to a Court. We cannot investigate the evidence an officer gives in Court hearings.
  3. The Council has refused to reply to Mr X’s complaint while the Court proceedings continue. We cannot investigate how the Council replied to Mr X’s complaint because we cannot look at the complaint itself.
