Summary: We cannot investigate this complaint that the Council has applied to the courts for a Special Guardianship Order. This is because the law does not allow us to investigate complaints about the start of court action.
The complaint
- The complainant, who I will call Miss X, complains that the Council has applied to the courts for a Special Guardianship Order (SGO) for her child. Miss X is worried what impact this will have on her contact arrangements with the child.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate a complaint about the start of court action or what happened in court. (Local Government Act 1974, Schedule 5/5A, paragraph 1/3, as amended)
