  • London Legacy Development Corporation Ltd (24 003 568)

    Statement Not upheld Other 30-Jan-2025

Summary: X complained that the London Legacy Development Corporation (LDDC) failed to take planning enforcement action in relation to several breaches of planning control. X said that because of the failure to act, they are affected by unpleasant odour from refuse bins and a family member has limited access to disabled parking spaces. We have decided to end our investigation because from December 2024 the LDDC is no longer a planning authority, and its planning enforcement function has returned to a local council. The local council has begun investigating the alleged breaches of planning control.

  • Sandwell Metropolitan Borough Council (24 003 578)

Statement Upheld Refuse and recycling 30-Jan-2025

Summary: Mr X complained his bins are not properly returned, despite numerous complaints and Council promises. He said this has a disproportionate impact on him because he has disabilities and struggles to put his bins back himself. We find the Council at fault, and this caused injustice. The Council has agreed to apologise, make a payment to Mr X, and carry out further monitoring.

  • Cheshire East Council (24 010 204)

Statement Not upheld Antisocial behaviour 30-Jan-2025

Summary: Mr X complains the Council has not provided Adult Social Care support and not dealt with reports of anti-social behaviour. The Council is not at fault.

  • Slough Borough Council (23 002 200)

Statement Upheld Special educational needs 30-Jan-2025

Summary: Mr X complained the Council failed to reassess his child’s special educational needs, leading to a delay in issuing an amended final Education, Health and Care Plan. Mr X also said the Council failed to secure the existing education and therapy provision, failed to effectively communicate and keep proper records, and failed to properly manage his complaints. We have found the Council acted with fault, causing an injustice. We have considered the remedy the Council previously offered and made further recommendations. There are parts of Mr X’s complaint we cannot investigate. We explain why in our decision statement.

  • North Lincolnshire Council (24 013 666)

Statement Closed after initial enquiries Antisocial behaviour 30-Jan-2025

Summary: We will not investigate this complaint about the Council’s decision not to reduce the height of its trees growing near Mr X’s home. We cannot achieve the outcome he is seeking.

  • Broadland District Council (24 013 768)

Statement Closed after initial enquiries Homelessness 30-Jan-2025

Summary: We will not investigate this late complaint about the Council’s homelessness and housing benefit decisions. Both decisions brought a statutory right of appeal, which were reasonable for Mr X to use. In any event, there is not a good reason for the delay in Mr X bringing the matter to the Ombudsman.

  • Ribble Valley Borough Council (24 013 851)

Statement Closed after initial enquiries Councillor conduct and standards 30-Jan-2025

Summary: We will not investigate this complaint about how the Council dealt with a complaint about the conduct of a town councillor. This is because we are unlikely to find fault.

  • Ashford Borough Council (24 013 873)

Statement Closed after initial enquiries Allocations 30-Jan-2025

Summary: We will not investigate Ms X’s complaint about how the Council handled her housing application. This is because there is not enough evidence of fault to justify investigating.

  • Essex County Council (24 014 091)

Statement Closed after initial enquiries Special educational needs 30-Jan-2025

Summary: We cannot investigate Ms X’s complaint the Council failed to provide her child with alternative provision and special educational provision. This is because Ms X has already used an alternative legal remedy when she appealed to a tribunal and these matters are closely related to that appeal. Nor will we investigate her complaint the Council did not provide school transport for her child because there is not enough evidence of fault by the Council to warrant an investigation.

  • Luton Borough Council (24 014 114)

Statement Closed after initial enquiries Transport 30-Jan-2025

Summary: We will not investigate Mr X’s complaint about the Council initially refusing his blue badge renewal application, requiring medical evidence to support his appeal, or how it dealt with his application. There is not enough evidence of fault in the Council’s decision-making process to warrant us investigating and investigation would not achieve a different outcome.
