Summary: The Council was at fault in how it reviewed and amended Mrs X’s child W’s Education, Health and Care Plan. It was also at fault for delay securing the provision in that Plan and for poor complaints handling. This caused Mrs X frustration and meant she had to go to undue time and trouble pursuing her complaint. It also meant W missed out on provision they should have had. To remedy their injustice, the Council will apologise to Mrs X, pay her £1100 and confirm the name of the member of staff who will act as her single point of contact in future.

Summary: We will not investigate Ms X’s complaint about the Council’s delay in carrying out a review because it has already apologised and offered to pay her £100 for the injustice caused. Further investigation is unlikely to lead to a different outcome. There is otherwise insufficient evidence of fault in the way the Council handled the offer of a property to discharge its homelessness duty to justify our involvement.

Summary: Mr X complained the Council delayed in dealing with his homelessness application and review request. We found the significant delays in dealing with dealing with Mr X’s homelessness application and review request are fault. As is the delay in providing temporary accommodation having determined Mr X was in priority need. These faults have caused Mr X difficulties and distress and meant he lived in his car for longer than he otherwise would have. The Council has agreed to apologise and make payments to Mr X and take action to address its delays.

Summary: Ms A complained that the Council did not appropriately support her child when she was unable to attend her school due to serious mental health issues. We found the Council is at fault and has caused an injustice as the child has missed out on education. The Council agreed to apologise and make a recognition payment.

Summary: Miss E complained she had been asking the Council for years to provide her with an education, including a package of education out of school. The Council kept ignoring her. It delayed its complaint response. We uphold the complaint. Because of the fault Miss E did not receive the contents of her Education, Health and Care Plan. The Council has agreed to apologise and make Miss E a symbolic payment.

Summary: Mr X and Ms Y complained the Council incurred delays in carrying out a care needs assessment for Mr X and in finding him suitable accommodation. They also complained the Council delayed pursuing a possible placement at a preferred setting. Mr X and Ms Y say the Council’s actions caused avoidable distress and frustration. We found fault by the Council. The Council has agreed to provide an apology and a financial remedy to Mr X and Ms Y.
