Summary: Mr X complained about the Council’s poor handling of his homelessness application and failure to provide suitable temporary accommodation. We found the Council to be at fault. It failed to properly consider his priority need and this led to him being denied temporary accommodation for several months. It also incorrectly closed his application and did not carry out suitability assessments for three temporary properties he was offered. To remedy the injustice to Mr X, the Council has agreed to apologise, make a payment to Mr X and take action to improve its service. We did not investigate Mr X’s complaint about the Council’s decision to discharge the main housing duty. This was because he had a right to challenge this decision in court.

Summary: Ms X complained about the Councils handling of her son, Y’s, Education, Health and Care Plan. She said the Council failed to complete a transition review and failed to secure education and the provision in the plan. Ms X said this distressed and frustrated her and Y missed education and plan provision. There was fault in the way the Council delayed starting consulting with other educational provisions, distressing Ms X. The Council has apologised. This is a suitable remedy.

Summary: Mrs X complained on behalf of her son, Mr Y, the Council refused to pay for the two-to-one care Mr Y needed and had not completed a review of his care needs between March 2022 and September 2023. The Council failed to properly assess, plan and review Mr Y’s care needs and did not communicate with Mrs X. The Council will apologise to Mrs X and pay her a symbolic amount of £500 to recognise the frustration, uncertainty and distress this caused her and will remind relevant officers to keep clear, complete and contemporaneous records.

Summary: The Council was at fault for failing to find education for
Mrs X’s son after he moved into its area. This caused him an injustice. Mrs X was also caused avoidable distress, as she went to significant efforts trying to secure education for her son. The Council has agreed take action to remedy their personal injustice, and it will take steps to improve its service. -

Miss X said this distressed her and her family. We have discontinued our investigation as the Health and Safety Executive is better placed to consider the matters Miss X complained about. The Ombudsman will not investigate the Council complaint handling if we are not considering the substantive matters.
