  • Manchester City Council (24 010 478)

Statement Closed after initial enquiries School transport 03-Dec-2024

Summary: We will not investigate Miss X’s complaint about the Council’s decision not to provide her child with free transport to school. This is because there is not enough evidence of fault by the Council.

  • Westmorland and Furness Council (24 010 517)

Statement Closed after initial enquiries Other 03-Dec-2024

Summary: We will not investigate Ms X’s complaint about the conduct of a Council social worker because it is late.

  • Blackburn with Darwen Council (24 012 777)

Statement Closed after initial enquiries Council tax 03-Dec-2024

Summary: We will not investigate this complaint about Council tax liability as there is a right of appeal to a Valuation Tribunal.

  • City of Doncaster Council (24 013 100)

Statement Closed after initial enquiries Enforcement 03-Dec-2024

Summary: We will not investigate this complaint about the way the Council have investigated an alleged breach of planning control. The Council has confirmed there is an ongoing investigation. Further investigation by the Ombudsman would not achieve anything worthwhile while that is the case.

  • Bournemouth, Christchurch and Poole Council (24 013 124)

Statement Closed after initial enquiries Refuse and recycling 03-Dec-2024

Summary: We will not investigate Mrs X’s complaint that the Council’s waste collection service damaged her bin. This is because an investigation is unlikely to achieve any worthwhile outcome, and Mrs X’s claimed injustice is not significant enough to warrant an investigation.

  • Melton Borough Council (24 014 952)

Statement Closed after initial enquiries Planning applications 03-Dec-2024

Summary: We will not investigate this complaint about how the Council dealt with a planning application. This is because we are unlikely to find fault.

  • Wealden District Council (24 015 370)

Statement Closed after initial enquiries Other 03-Dec-2024

Summary: We will not investigate this complaint about the Council’s responses to Mr X’s request for information about Council staff. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. There is insufficient evidence of fault causing injustice to warrant an investigation.

  • Bolton Metropolitan Borough Council (24 015 472)

Statement Closed after initial enquiries Council tax 03-Dec-2024

Summary: We will not investigate Mr X’s complaint that his property is in the wrong council tax band. This is because we cannot investigate the banding decision made by the Valuation Office Agency. Also, the Council is not at fault for using the band provided by the Valuation Office Agency.

  • Oxfordshire County Council (23 016 722)

Statement Upheld Special educational needs 03-Dec-2024

Summary: Mr X complained the Council failed to meet the statutory timescales in reviewing and producing his child’s Education, Health and Care Plan. Mr X also complained about the way in which the Council handled his complaint. We found fault with the Council’s delays in handling both the Education, Health and Care Plan review and Mr X’s complaint. The Council offered £200 for it’s poor complaint handling and £300 for the delays in reviewing the Education, Health and Care Plan. This was a suitable symbolic gesture with an apology for the injustice caused by the Council’s fault.

  • Essex County Council (23 017 745)

Statement Upheld Assessment and care plan 03-Dec-2024

Summary: Miss X complained about the Council’s decision to stop funding activities that were previously included in her daughter, Y’s care plan, and said the Council failed to consider Y’s disability related expenditure. We find the Council at fault for the removal of an activity, miscommunication, and delay considering Y’s disability related expenditure. This has caused uncertainty, distress, and a loss of funding. The Council has agreed to apologise, make a payment to Miss X, and improve its service.
