Summary: Mr X complains about the Council’s enforcement of a Business rates debt. The Ombudsman will not investigate this complaint because this was a matter for the courts.

- Mr X complains about the Council’s enforcement of a Business rates debt.

- We have the power to start or discontinue an investigation into a complaint within our jurisdiction. We may decide not to start or continue with an investigation if we think the issues could reasonably be, or have been, raised within a court of law. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
- I have considered the comments of the complainant and the Council and the complainant has had an opportunity to comment on the draft decision.,
What I found
- Mr X disputes Business rates bills issued to him by the Council. The Council issued a reminder for unpaid Business rates on 15 April 2019 and a summons issued on 17 May. A Liability Order was issued on 6 June which included £180 costs.
- The Ombudsman considers that any dispute about liability or quantum of Business rates is a matter for the courts. They are an expert body whose decisions are binding on the Council. Mr X could reasonably have applied for the court’s decision to be set aside (as advised by the Council).
