- Mr X complains the Council has wrongly refused his application for housing benefit.

- I considered information provided by the complainant and the Council.
- I considered the Ombudsman’s Assessment Code.
My assessment
- The Council has refused Ms X’s application for housing benefit on the grounds that the accommodation he is living in does not meet the eligibility criteria. The Council advised him how to appeal the decision in letters sent in June 2022 and July 2023.
- Only a tribunal can decide whether Mr X is eligible for housing benefit. Mr X has told us he has used his right of appeal and so we cannot investigate this complaint.
Final decision
- We cannot investigate Mr X’s complaint about housing benefit eligibility because he has used his right of appeal to a tribunal.
