We found the Council to be at fault. To remedy the injustice to Mrs X, the Council has agreed to apologise and make a payment to her to acknowledge her distress, Y’s loss of education and support for his special educational needs. We did not investigate part of Mrs X’s complaint because they related to matters that were appealable to the SEND Tribunal.
