The EHC Plan should have been issued within 20 weeks but after 22 months the Council has still not issued the final version. It also failed to take appropriate action when provided with information that Miss X’s son was not attending school. This is fault and a suitable remedy is agreed.

We have recommended a suitable remedy for the injustice caused in this case and so have completed our investigation.

    Summary: Mrs X complained about the Councils handling of her Disabled Facilities Grant application. She also complained about poor communication. Mrs X said this distressed her family. There was fault in the way the Council delayed approving the application and miscommunication. This fault distressed and frustrated Mrs X. The Council should apologise, make a financial payment and remind staff about its duties.

There was also fault in the complaint handling. Ms X suffered distress, uncertainty and was placed in financial difficulty. The Council has agreed to apologise, make a financial payment and issue guidance to its staff.
