  • Essex County Council (24 007 940)

Statement Upheld Special educational needs 24-Mar-2025

Summary: The Council failed to make sure that Mrs B’s son received his full provision as set out in his Education Health and Care Plan. There was fault by the Council because it failed to review and amend the Plan in accordance with government guidance. The lack of support meant that her son failed his college exams and lost his apprenticeship. The Council has improved how it handles transitions for post-16 students, with a new dedicated team. It should also apologise to Mrs B and her son, and make a payment to recognise the impact on them both.

  • Wiltshire Council (24 008 022)

Statement Upheld Special educational needs 24-Mar-2025

Summary: Mrs X complained that the Council did not provide her child with education and the provision in their Education, Health and Care Plan when they were out of school. This meant her child missed out on a period of education. We have found the Council at fault for periods where Mrs X’s child did not receive provision. To remedy the injustice caused, the Council agreed to apologise, make a payment for loss of education and put in place some missed provision.

  • Buckinghamshire Council (24 008 183)

    Statement Upheld Alternative provision 24-Mar-2025

Summary: Ms X complained the Council had not completed an Education, Health and Care Needs Assessment for her daughter and not provided an Education, Health and Care Plan. The Council delayed completing both. This has caused Ms X distress and her daughter to miss out on education. I have recommended a financial remedy.

  • Staffordshire County Council (23 016 017)

Statement Upheld Special educational needs 24-Mar-2025

Summary: Mrs X complains the Council failed to ensure her child P received the special educational needs provision and social care support in their Education, Health, and Care Plan. There was fault by the Council which caused P to miss provision. This also caused distress to P and Mrs X. The Council agreed to apologise, evidence it is taking action to ensure P’s provision is in place, and pay a financial remedy. It will also review its processes for checking Education, Health, and Care Plan provision is in place.

  • Warwickshire County Council (24 011 442)

    Statement Upheld Charging 24-Mar-2025

Summary: Mr X complained the Council did not tell him it was charging him for his care until a month after he had received the care. I have discontinued my investigation. This is because the Council offered a suitable remedy for Mr X’s financial injustice and we are unlikely to achieve a different outcome.

  • London Borough of Camden (24 011 470)

Statement Upheld Disabled facilities grants 24-Mar-2025

Summary: Mr X complained the Council failed to properly consider Disabled Facility Grants he requested in 2022 and 2023. We found there was delay in responding on both occasions. We did not find fault in the handling of the 2022 application. We also found no fault in the decision to refuse the grant in 2023. However, we recommended the Council should apologise for the delays and provide guidance to staff about to ensure they applied the correct tests and explained the Councils decisions appropriately.

  • Bath and North East Somerset Council (24 011 514)

Statement Closed after initial enquiries Charging 24-Mar-2025

Summary: We will not investigate Ms X’s complaint about the Council’s assessment of Mrs Y’s social care charges. There is not enough evidence of fault to justify an investigation.

  • Leeds City Council (24 011 854)

Statement Closed after initial enquiries Charging 24-Mar-2025

Summary: We will not investigate Mr X’s complaint about the Council failing to take appropriate responsibility for Ms Z’s care fees. This is because the alleged fault has not caused any injustice to Ms Z.

  • Liverpool City Council (24 013 549)

Statement Closed after initial enquiries Leisure and culture 24-Mar-2025

Summary: We will not investigate this complaint about the Council’s decision on the allotment fees it intends to charge. This is because there is no worthwhile outcome we can achieve by investigating.

  • West Northamptonshire Council (24 015 400)

Statement Closed after initial enquiries Allocations 24-Mar-2025

Summary: We will not investigate this complaint about the Council’s handling of Mrs X’s rehousing application. This is because we are unlikely to find evidence of fault by the Council sufficient to warrant an investigation.
